Artist Agreement

The agreement is as follows:

The above artist appoints the Big Bend Arts Council (BBAC) as agent for the purpose of exhibition and sale of the works listed in the inventory of the gallery. This artist’s work has been accepted for display in the gallery.

1) Costs, commissions and fees

a) The member artist must be a member in good standing (paid in full member) of the BBAC.

b) BBAC shall sell the works at the selling price listed by the artist in the inventory record.

c) BBAC will pay costs of those items as outlined in the Gallery Manual. The artist agrees to pay a 20% commission on all works sold through BBAC. Once earned, a commission will not be refunded.

d) $50.00 non refundable entry fee shall be paid by the artist upon acceptance into

the gallery.

e) The artist will pay a monthly fee of $20. This monthly fee is due by the 10th of each month. The artist may pay a fee of $10.00 a month if occupying half the usual space.

f) The gallery director and bookkeeper will maintain the records for the gallery. The artist will be paid on sales after deduction of commission each month.

g) In January of each year, the Gallery director will re-evaluate the income and expenses of the gallery. Should the monthly fee or the commission percentage require adjustment, all artists will be notified of such changes 60 days before their contract expires. Any new adjustments will be part of the next year’s contract.

2) Artwork

All artwork brought to BBAC shall be up to the standards of quality of the medium that the artist is exhibiting and must be ready to hang or ready to put on display.

All matters relating to copyright and other principles of intellectual property law, and all matters relating to longevity of the artist’s medium (including but not limited to fading, cracking, discoloration and other production defects) and any disputes between artist and the purchaser are solely the responsibility and liability of the artist.

All artwork shown in the gallery must be the original work of the artist or signed and numbered limited editions of prints. All artwork is the property of the artist until sold.

3) Artist Responsibilities

a) All matters relating to shipping, purchaser returns, refunds, complaints, and other issues in connection with a sale are solely the responsibility of the artist.

b) Special display needs for the artist’s work will be provided by the artist.

c) All works shown in the gallery are shown at the artist’s risk. BBAC will take every reasonable precaution to protect the artist’s work; the gallery accepts no responsibility for any damage or loss of art. Insurance of artwork is the artist’s responsibility

d) The artist must participate in one of four committees as described in the Gallery Manual. These committees are: Display Committee, Events Committee, Administration Committee and Marketing/Publicity Committee. The extent to which participation is applied is linked to the location of the artist to the Gallery.

e) Artists are expected to attend all special gallery promotions and announced gallery member meetings. The artist is encouraged to participate in receptions, meetings and events involving the gallery.

f) To the extent that the member is available, he or she will be required to participate in all activities of a committee.

g) Upon leaving the gallery membership, the artist must remove all his/her artwork within one week. Artwork not removed after one week past termination of membership will be held in storage and a storage fee of $5.00/day will be charged until the work is picked up.

4. Terms of this contract. This contract is valid until March 31st, 20___and may be renewed for the following year.

5. Early termination of this contract.

An artist may be removed from the gallery for cause. Should such a course of action be necessary, the gallery director will first address the concerns in writing with the artist. Should the artist fail to make the necessary corrections or relay a plan of corrective action within 5 days, the gallery director may then present the reasons for removal in writing to the rest of the membership in a special session. The members present will determine a suitable course of action, up to and including removal of the artist from the gallery, by a majority vote of the artists present. The artist under review may be present for the discussion, but must not be present for the vote. Reasons for termination include:

Theft. Theft is grounds for immediate termination.

Three months arrears in monthly dues

Flagrant and deliberate violation of copyright/intellectual property laws
